Acceptable Usage Policy

This Acceptable Usage Policy (AUP) outlines the rules and standards governing the use of Datasoft Networks servers, networks, and hosting infrastructure.

Section 1

Overview & Scope

This Acceptable Usage Policy ("AUP", "Policy") defines the acceptable use of all hosting services, computing systems, virtual machines, dedicated servers, internet transit links, and network facilities provided by Datasoft Networks Inc. ("Datasoft Networks", "we", "us", or "our").

The primary purpose of this Policy is to protect the operational integrity, reliability, and security of our global infrastructure, comply with federal and state laws of the United States, and safeguard our customers from malicious activities. This Policy applies to all customers, authorized users, sub-accounts, and third parties accessing services provisioned under your account.

Section 2

Prohibited Content & Activities

You may not use Datasoft Networks infrastructure to host, transmit, link to, or facilitate any content or activity that is unlawful, harmful, deceptive, or infringing. Strictly prohibited activities include:

  • Child Sexual Abuse Material (CSAM): Hosting, transmitting, or referencing any CSAM or child exploitation material is subject to immediate service termination, irreversible data forfeiture, and immediate reporting to the National Center for Missing & Exploited Children (NCMEC) and federal law enforcement agencies.
  • Copyright & Trademark Infringement: Unlawful distribution of copyrighted multimedia, pirated software ("warez"), counterfeit goods, unauthorized ROMs, or operating public torrent trackers and unauthorized seedboxes.
  • Malware & Exploit Distribution: Hosting, distributing, or executing ransomware, trojans, viruses, keyloggers, rootkits, botnet command-and-control (C2) nodes, or zero-day exploit payload servers.
  • Phishing & Financial Fraud: Operating fraudulent websites, phishing pages impersonating banks or organizations, fake escrow services, stolen credential dumps, or unauthorized credit card verification engines.
  • Defamation, Harassment & Hate Speech: Hosting content that promotes illegal violence, terrorist activity, or illegal harassment targeting individuals or communities.
  • Illegal Gambling & Narcotic Distribution: Unlicensed online casinos, illegal sports betting systems, or distribution of illicit substances in violation of applicable laws.
Section 3

Network & Infrastructure Security

The stability of our datacenter network relies on responsible utilization. Any action that disrupts, attacks, or probes third-party systems or Datasoft Networks equipment is strictly prohibited:

  • Denial of Service Attacks: Originating, facilitating, or participating in Distributed Denial of Service (DDoS), SYN floods, UDP amplification, DNS reflection, or any network flood attacks.
  • Unauthorized Scanning & Probing: Port scanning, vulnerability probing, packet sniffing, IP spoofing, or automated brute-force attacks against third-party servers without verifiable written authorization.
  • Open Proxies & Anonymization Abuse: Operating open proxies, unsecured DNS resolvers, open relay mail servers, or public TOR exit nodes without prior written agreement from our network operations team.
  • Cryptocurrency Mining Abuse: Running background cryptocurrency mining software (e.g. Monero/Bitcoin miners) on shared virtualization platforms (Web Hosting, Cloud Servers) that causes sustained 100% CPU saturation or thermal degradation on host hardware.
Section 4

Email, Messaging & Anti-Spam Policy

Datasoft Networks maintains a Zero-Tolerance Policy against Unsolicited Commercial Email (UCE) and Unsolicited Bulk Email (UBE), commonly known as "Spam".

Anti-Spam Enforcement: Originating spam from our network or hosting websites advertised within spam emails sent from external networks ("spamvertising") results in immediate server suspension and permanent blacklisting.

  • List Acquisition: You may not send emails to rented, purchased, compiled, or scraped email lists. All mailing lists operated from our network must be 100% verified opt-in (confirmed double opt-in).
  • CAN-SPAM & Global Compliance: All marketing emails must include an accurate physical postal address, a functional 1-click unsubscribe mechanism that is honored immediately, and honest sender headers.
  • Email Rate Limits: Shared Web Hosting and Email Suite plans have hourly outbound email sending limits to preserve server IP reputation across major mail providers (Gmail, Outlook, Yahoo). High-volume transactional senders should utilize dedicated IP options.
Section 5

System Resources & Fair Share Policy

Different hosting tiers operate under distinct resource models to ensure consistent performance for all clients:

  • Shared Web Hosting & Email Suite: Designed for personal, corporate, and e-commerce websites. Accounts may not be used exclusively as mass public file archives, remote backup repositories, or streaming file caches that degrade disk I/O performance for other users on the server.
  • Cloud Server & KVM VPS Hosting: Virtual machines receive guaranteed dedicated virtual CPU cores, allocated ECC RAM, and fast SSD/NVMe block storage. While continuous usage of your allocated compute resources is permitted, automated processes designed solely to disrupt neighbor instances are forbidden.
  • Dedicated Servers: Dedicated server customers have exclusive access to 100% of their physical server hardware, operating systems, and dedicated 1 Gbps port capacity, subject to standard network abuse rules.
Section 6

Customer Security Obligations

Maintaining security is a shared responsibility. Customers are expected to implement reasonable security precautions on their provisioned services:

  • Software Patching: Regularly update content management systems (e.g., WordPress, Joomla), web applications, scripts, and operating system packages to patch known vulnerabilities.
  • Credential Hygiene: Utilize strong passwords (minimum 12 characters with mixed complexity) and enforce SSH key authentication where possible.
  • Compromised Systems: If a customer instance is compromised by third parties (e.g., infected with a botnet or backdoor script), Datasoft Networks may isolate the instance network port to mitigate damage while the customer performs cleanup and restoration.
Section 7

Investigation & Enforcement

Datasoft Networks reserves the right to assess the severity of any reported abuse incident and take proportional remediation steps:

  • Warning & Remediation Notice: For unintentional infractions (such as an outdated WordPress plugin exploited by third parties), we notify the customer via email or ticket with a specified timeframe for remediation.
  • Temporary Containment: In urgent cases threatening network integrity (e.g. active outgoing DDoS floods), we may null-route the IP address or pause the virtual machine temporarily until security is restored.
  • Immediate Termination: Severe, intentional, or repeated violations (including CSAM, deliberate botnet operations, or massive phishing campaigns) result in immediate, permanent termination without refund.
Section 8

Reporting Abuse & Inquiries

We work closely with network operators, security researchers, and law enforcement to maintain a safe and clean network. To submit a verifiable abuse complaint, please include specific destination/source IPs, relevant server log excerpts, and email headers.
